I am Patrick Visser, a sole trader in New South Wales, Australia, trading as Patrick Visser Art (ABN 64 546 216 760). I run the shop at patrickvisser.art, where I sell original paintings.
This policy explains what I collect when you buy something, who else sees it, and what you can ask me to do with it. I have kept it short because the shop does very little with your information.
What this policy covers
This policy covers the shop at patrickvisser.art and nothing else. My YouTube channel, Substack newsletter, Patreon page, and Instagram account each run on platforms with their own privacy policies, and those platforms hold that data, not me.
What I collect
When you place an order, I collect only what is needed to send you a painting:
- your name
- your email address
- your shipping address
- your billing address, if it differs
- what you ordered, and when
I never see or hold your card number. Payments go straight to [Stripe / PayPal], who handle the card details themselves.
The shop also records basic visit statistics through Big Cartel, such as how many people viewed a page and which site sent them. This does not identify you.
What I do not do
- The shop has no mailing list and no signup form. Buying a painting does not add you to anything.
- I run no analytics or advertising trackers. No Google Analytics, no Meta pixel, no third-party ad code.
- I never sell, rent, or trade your information, and I never pass it to another business for marketing.
Who else handles your information
Three parties touch your order, and each does one job:
- Big Cartel hosts the shop and stores the order records. Big Cartel is based in the United States.
- Stripe processes your payment.
- Australia Post receives your name and delivery address so the parcel reaches you.
Beyond these, I share your information only if the law requires it, for example a valid request from a court or government agency.
Where your information is stored
Mostly outside Australia. Big Cartel stores order records in the United States, and the payment processor may hold records in the United States or elsewhere. By placing an order you accept that your information is sent overseas and held there.
Why I am allowed to hold it
Two reasons, and no others:
- To fill your order. I cannot post you a painting without a name and an address.
- To meet Australian tax law. I have to keep sales records.
If you are in the EU or the UK, these are the lawful bases under Article 6 of the GDPR: performance of a contract, and compliance with a legal obligation.
How long I keep it
Australian tax law requires me to keep sales records for five years from the date of the transaction. After that I delete them.
What you can ask me to do
You can ask me to:
- tell you what I hold about you
- send you a copy of it
- correct anything wrong
- delete it, unless the five-year tax rule still applies
If you are in the EU or the UK, you can also ask me to move your data to another provider, to object to how I use it, or to restrict my use of it.
Email me at [email protected] and I will reply within 30 days. Big Cartel does not answer these requests on my behalf, so please come to me rather than to them.
Complaints
Tell me first, at [email protected], and I will try to sort it out. If you are not happy with my answer:
- In Australia, complain to the Office of the Australian Information Commissioner.
- In the UK, complain to the Information Commissioner's Office.
- In the EU, complain to the data protection authority in your country.
Cookies
Big Cartel sets a small number of cookies so the shop works: keeping your basket, remembering the checkout step you reached, and counting page views. There are no advertising or tracking cookies on this site.
You can block cookies in your browser settings. If you do, the basket and checkout stop working.
Security
Big Cartel and the payment processor hold your order data on their own secure systems. No system on the internet is completely safe, so I cannot promise absolute security. If a breach puts your information at serious risk, I will tell you and notify the Office of the Australian Information Commissioner.
Children
The shop sells original paintings to adults. It is not aimed at children, and I do not knowingly collect information from them. If you believe a child has given me their details, email me and I will delete them.
Changes to this policy
If I change how the shop handles your information, I update this page and change the date at the top. Check back if you want to see whether anything has moved.
